Definitions |

| 1.1 |

‘Agent’ means Laser Trader Limited (Registered in England as company number 4112559) of Dunston Innovation Centre, Dunston Road, Chesterfield, S41 8NG. |

‘Buyer’ means the person who buys or agrees to buy the Goods from the Seller. |
| 1.3 |
|
‘Conditions’ means the terms and conditions of sale set out in this document any any special terms and condions agreed in writing by the Seller. |
| 1.4 |
|
‘Fee’ means the fees charged by the Agent for acting as Agent of the Seller, comprising 10% of the Price plus VAT. |
| 1.5 |
|
‘Goods’ means the articles which the Buyer agrees to buy from the Seller. |
| 1.6 |
|
‘Price’ means the price of the Goods excluding carriage, packing, insurance and VAT. |
| 1.7 |
|
‘Seller’ means the person placing the Goods for sale on the web site. |
| 1.8 |
|
‘Web Site’ means the internet web site operated by the Agent for the advertisement of used laser equipment. |

Conditions applicable |

| 2.1 |

These Conditions shall apply to all contracts for the sale of Goods by the Agent on behalf of the Seller to the exclusion of all other terms and conditions. |
| 2.2 |
|
Posting an advertisement for the sale of Goods on the web site shall be deemed conclusive evidence of the Seller’s acceptance of these Conditions. |
| 2.3 |
|
Any variation to these Conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by the Agent. |

| 3 |
|
Obligations of the Agent |
|

|
| 3.1 |
|
To publish and keep the details of the Goods on the web site until notified otherwise by the Seller provided always that after 12 months the Agent may at its discretion remove the details of unsold Goods. |
| 3.2 |
|
On enquiry to provide details of the Goods and their whereabouts to prospective buyers. |

|
|
| 4 |
|
Obligations of the Seller |
|
|
|
| 4.1 |
|
To provide the Agent with full particulars of the Goods and the Seller hereby warrants to the Agent that the Goods are in good working order and are the unencumbered property of the Seller who has full authority to sell them. |
| 4.2 |
|
To notify the Agent when a sale of the Goods has taken place. |
| 4.3 |
|
To pay the Fees to the Agent within 14 days of completion of the sale of the Goods. |

| 5 |
|
Indemnity and Exclusion of Liability of Agent |
|
|
|
| 5.1 |
|
It is acknowledged by the Seller that the Agent shall act at all times as Agent for the Seller and never as partner or principal. |
| 5.2 |
|
The Seller agrees to indemnify the Agent against all actions claims and demands arising from the sale of the Goods.
